What Can You Do If You Suffered a Loss Through a Real Estate Broker in Korea?

It's not uncommon for a foreign tenant signing a jeonse or monthly rental contract in Korea to later discover an existing mortgage or a senior tenant with priority claims, or to find the contract terms differ from what the broker had explained. The bottom line: if a licensed real estate broker fails to properly verify and explain key facts and a loss results, this constitutes broker malpractice for which damages can be claimed — and in many cases, real compensation is available through the mandatory insurance or guarantee fund the broker is required to carry.

What does it take for broker malpractice to be recognized?

Under Korea's Licensed Real Estate Agents Act, a broker has a duty to verify and explain the legal status of the property, any encumbrances such as mortgages or provisional seizures registered on the title, and whether the actual owner matches the contracting party. If a broker neglects this duty and the tenant loses their deposit as a result, liability for damages arises so long as a causal link between the broker's negligence and the loss is established. That said, whether the risk factor was disclosed in the written property disclosure statement provided at signing, and whether the tenant proceeded despite being aware of it, are the key issues that determine the scope of liability.

What steps should be taken if a landlord won't return the deposit?

If a landlord fails to return the deposit after the lease ends, a tenant can file for a registration order for the leasehold right, which preserves the tenant's right to assert the lease against third parties and priority repayment status while allowing them to move out. From there, a tenant can pursue a lawsuit for return of the deposit or a payment order procedure, ultimately proceeding to compulsory execution if necessary. For properties like multi-household houses where several senior tenants with priority claims exist, there is a real risk of being pushed down the repayment order and failing to recover the full deposit, so checking the property register and the status of fixed-date registrations before signing is essential.

How can you prove the broker's explanation was inadequate?

The most important evidence in a broker malpractice dispute is the written property disclosure statement provided at signing, along with text messages or recordings that support what the broker explained verbally. If the disclosure statement omits information about a mortgage or a senior tenant, that omission itself becomes strong evidence of the broker's breach of duty. Foreign tenants often sign documents without interpretation or translation during the contracting process — it's advisable to keep copies of all documents from the outset so this doesn't work against a later claim of inadequate explanation.

How can compensation be obtained through the broker's insurance or guarantee fund?

Licensed brokers are required to carry insurance or a guarantee fund to cover liability for damages before starting business, and if a loss results from broker malpractice, compensation can be paid out through this fund. However, the fund has a coverage limit, and any loss exceeding that limit requires a separate damages claim against the broker personally. A claim against the fund also requires evidence proving both the malpractice and the amount of loss, so organizing documentation from the early stages speeds up the process.

Real estate brokerage disputes have a tendency where the recoverable scope narrows over time due to repayment priority and statute of limitations issues. Jinheon Law Firm provides step-by-step support for foreign tenants — from deposit recovery to broker malpractice damages claims and claims against brokers' insurance or guarantee funds.
