Media Interview | Overheated Secondhand Market and Risks of Dealing in Stolen Goods Amid Soaring RAM Prices

Shin Min-young, Managing Partner at Law Firm Jinheon, recently provided legal insight in a media interview regarding the potential circulation of stolen goods in connection with the sharp rise in memory prices.

Attorney Shin explained, “Business operators engaged in purchasing goods for commercial purposes may be held to a higher standard of due diligence than ordinary consumers. If a buyer proceeds with a transaction without proper verification despite suspicious circumstances—such as a price significantly below market value or an unusually large-volume sale—constructive intent (dolus eventualis) may be recognized, potentially leading to criminal liability.”

He further noted, “In a recent gold shop case, business owners who neglected their duty of verification were booked on charges of occupational negligence in acquiring stolen property. Where there are reasonable grounds for suspicion, it is necessary to suspend the transaction and implement internal control procedures to verify the origin and acquisition history of the goods.”
