Shin Min-young, Managing Partner of Jinheon Law Firm, explained in a media interview that
“the use of physical force directed at a person may constitute assault regardless of its intensity or actual contact.”

In a prior ruling, the Supreme Court recognized assault when a plastic cup was thrown in a karaoke room even though it did not strike anyone,
finding guilt based on the victim’s consistent testimony, on-site circumstances, and the defendant’s remarks.

Attorney Shin also noted that “Korean criminal law adopts both the principles of nationality and territoriality, meaning crimes committed abroad may also be subject to punishment.”
