Convicted of Fraud in Used Construction Equipment Sale — Prison Term Avoided on Appeal Through Sentencing Mitigation

20 May 2026

Case at a Glance

Our client had been convicted of fraud in connection with a used construction equipment transaction and sentenced to eight months' imprisonment at first instance. The client's single, non-negotiable objective was to stay out of prison. Law Firm Jinheon focused the appeal entirely on sentencing — making a formal deposit of compensation to demonstrate genuine willingness to make the victim whole, and proving that the victim had in fact been operating the equipment normally since purchasing it. The appellate court found the original sentence excessive, reversed the first instance judgment, and imposed a suspended sentence. Our client did not go to prison.

1. Why the Client Came to Law Firm Jinheon

Our client had sold a piece of used construction equipment and was convicted of fraud on the basis that the machine's actual operating mileage — approximately three times what the instrument panel displayed — had not been disclosed to the buyer. The first instance court sentenced the client to eight months' imprisonment, citing the dishonest nature of the conduct, the absence of remorse, no effort to compensate the victim, and a prior criminal record including similar offences.

There were, however, circumstances that had not been fully brought to bear in the client's favour: the actual profit from the transaction was not large, the client was willing to take concrete steps toward compensating the victim, and — critically — the victim had continued operating the equipment after the purchase. The client came to Law Firm Jinheon with one clear instruction: do whatever it takes to keep me out of prison.

2. Law Firm Jinheon's Legal Strategy

The goal of the appeal was not to overturn the conviction — the facts as found by the trial court were not going to change. The objective was a suspended sentence, and everything was designed toward that end.

First, we made a formal deposit of compensation to demonstrate concrete willingness to make the victim whole. Even where a victim refuses to accept the deposited funds — as happened here — the act of making the deposit itself is recognised by Korean courts as a meaningful indication of the defendant's remorse and intention to repair the harm caused. Law Firm Jinheon moved quickly to complete the deposit and ensured it was properly placed before the appellate court as a sentencing consideration.

Second, we proved that the victim had in fact been operating the equipment normally since the purchase. The victim had testified that the machine could not be operated — but the evidence showed that the victim had actually driven it a substantial distance after buying it. This discrepancy was directly relevant to the court's assessment of the real extent and severity of the harm. Law Firm Jinheon gathered the supporting evidence and presented it specifically in the context of the sentencing argument.

Third, we compiled and presented all favourable sentencing factors in a structured and comprehensive way — including the limited actual profit the client had made from the transaction, the concurrent sentencing relationship with other convictions already finalised, and all other relevant personal circumstances. The argument that the original sentence was disproportionately heavy was built from these materials and presented with precision.

3. The Outcome — Original Sentence Reversed, Suspended Sentence Imposed

The appellate court rejected the client's challenge to the factual findings, but accepted the sentencing challenge — finding the original sentence excessive. The court reversed the first instance judgment and imposed eight months' imprisonment suspended for two years, with 80 hours of community service.

The deposit, the evidence of the victim's actual use of the equipment, and the overall sentencing picture were taken into account together. Our client did not go to prison.

4. Why This Case Matters — And Why Choose Law Firm Jinheon

Turning a custodial sentence into a suspended sentence on appeal, where the conviction itself is being maintained, is not a matter of legal argument alone. It requires identifying every circumstance that could work in the client's favour, acting on those circumstances concretely before the hearing, and presenting the full picture to the court in a way that gives the judges a reason — and a basis — to choose the more lenient outcome.

Law Firm Jinheon delivered on all three: the formal deposit as a pre-emptive act of good faith, the evidentiary proof of the victim's actual use of the equipment, and a structured sentencing submission that put the original sentence in its proper perspective. The client's single goal — staying out of prison — was achieved.

If you have received a custodial sentence at first instance, do not assume the outcome is final. What is argued on appeal, and how, can change the result. Consult Law Firm Jinheon before taking any further steps.
