Intervening in an Ongoing Lawsuit as an Independent Party — Establishing Ownership Under a Real Estate Security Trust and Recovering Unjust Enrichment in Full

Case Type : Independent Party Intervention · Real Estate Security Trust Ownership Dispute · Unjust Enrichment Claim Outcome : Full Victory Handled by : Law Firm Jinheon

Case at a Glance

Our client, a financial institution holding legal ownership of a property under a real estate security trust agreement, found itself entirely excluded from litigation that was already underway between two other parties over rent and unjust enrichment relating to that very property. With its ownership rights directly at stake in proceedings to which it was not even a party, our client came to Law Firm Jinheon seeking a way forward. Law Firm Jinheon applied for independent party intervention, had the application recognised as procedurally valid by the court, and went on to establish our client's lawful ownership at the appellate stage — proving that the plaintiff had no right to possess the property and securing a full order for the return of unjust enrichment to our client.

1. Why the Client Came to Law Firm Jinheon

Our client was a financial institution that held legal title to a property under a real estate security trust agreement. Then came an unexpected discovery: litigation over rent and unjust enrichment relating to that same property was already in progress — between two other parties entirely, with our client cut out of the proceedings altogether.

Our client's ownership rights were directly implicated by the outcome of that litigation. Yet our client was not a party to it. Faced with the prospect of a court reaching conclusions about a property it owned without ever hearing from it, our client came to Law Firm Jinheon to find a solution.

2. Law Firm Jinheon's Legal Strategy

This case presented two distinct challenges. First: how to get our client into proceedings that were already underway between other parties. Second: once in, how to establish our client's ownership rights and recover what was owed.

Law Firm Jinheon addressed both through a three-stage strategy.

First, we applied for independent party intervention and secured recognition of our client's standing. Under Korean civil procedure, a third party with a direct legal interest in the subject matter of ongoing litigation may apply to join those proceedings as an independent party. Law Firm Jinheon filed such an application on the basis that our client, as the legal owner of the property at the heart of the dispute, had a direct and immediate stake in the outcome. The court recognised the application as procedurally valid, and our client obtained formal standing to advance its own claims within the existing litigation.

Second, at the appellate stage, we established our client's lawful ownership of the property under the real estate security trust agreement. We presented a clear and systematic account of the trust agreement and the legal effect of the ownership transfer it effected, demonstrating to the court that our client was the legitimate legal owner of the property. From that foundation, we showed that the plaintiff had no legal basis to possess or claim rights over the property at all.

Third, we claimed the return of unjust enrichment on the basis of the defendant's unauthorised occupation. Having established that the defendant was occupying the property without any lawful entitlement, we advanced the claim that the defendant had been unjustly enriched by the equivalent of the market rent for the period of occupation — and that this amount was owed to our client.

3. The Outcome — Full Victory

The court accepted Law Firm Jinheon's arguments in their entirety. Our client's lawful ownership under the real estate security trust was recognised, and the defendant was ordered to return the full amount of unjust enrichment — equivalent to the rent for the period of unauthorised occupation — to our client. A complete victory on all points.

A financial institution that had been shut out of litigation directly affecting its own property rights had, through independent party intervention, entered those proceedings and emerged with a full win.

4. Why This Case Matters — And Why Choose Law Firm Jinheon

What makes this case significant is the nature of the solution itself. Finding yourself affected by litigation you are not part of is a situation many clients do not know how to respond to. Should a separate lawsuit be filed? Should you wait for the existing proceedings to conclude? The path forward is far from obvious.

Law Firm Jinheon identified the precise procedural mechanism available under Korean civil law — independent party intervention — and deployed it as the optimal solution for our client's specific situation. Rather than standing on the sidelines or starting from scratch with separate proceedings, our client was brought directly into the existing litigation, established its ownership rights within those proceedings, and recovered the unjust enrichment it was owed — all in a single case.

The right answer to a legal problem is not always the most obvious one. Identifying the most effective legal tool for a client's specific circumstances, and using it with precision, is what Law Firm Jinheon does.
